Marine Liability Claims


What to do in the event of a possible liability claim

  • Immediately advise your Insurance Broker or our Marine Claims Centre.
  • We also recommend that you go back and familiarise yourself with the terms of your insurance policy, particularly the claims provisions.
  • In the event that a third party or company holds you or your company responsible for any loss, damage, injury or expense you should request that the complaint be put in writing detailing the nature and circumstance of the alleged matter and forward a copy of it to us as soon as it is received.

1. You must give us every reasonable opportunity to thoroughly investigate your claim to discover the facts and the cause or causes of the incident. This helps determine our response under the insurance contract and helps prevent any delays in the claim process.

2. If you are insured by a marine legal liability insurance policy or under a third party legal liability section of a marine insurance policy and are advised of an occurrence which may give rise to a claim against you or your company by a third party, you should:

  • Immediately advise your Insurance Broker or your local Vero Marine Office.
  • Gather evidence such as photographs, video, names of witnesses, diagrams and the like relevant to the incident and provide it to us as soon as possible.
  • Provide us in writing all details of the incident, any documents or information which we deem necessary to obtain, as soon as possible.
  • On receipt, forward to Vero Marine every letter, writ, summons or any other communications relevant to the claim.
  • Inform Vero Marine in writing of any notice of prosecution or inquest as soon as possible.

3. You should not, without our prior written consent, negotiate, pay, settle, admit or repudiate any claim made against you or your company by a third party (this includes anything which may be considered as an admission of liability).

4. We may appoint an investigator or a surveyor to look into the incident. They will assist in gathering information relevant to the claim.
